Key Directives and Penalties Imposed by CCI

On November 18, 2024, the CCI directed WhatsApp to halt the sharing of user data with Meta or its subsidiaries for advertising purposes for the next five years. This order was accompanied by additional remedial measures and a significant penalty of ₹213.14 crore on Meta for abusing its dominant position in the Indian market.

This decision strikes a considerable blow to Meta, which operates in India as its largest user base, with over a billion monthly users. WhatsApp alone boasts more than 500 million monthly active users in the country, making it a critical platform for Meta's operations and ambitions.

Investigation into the 2021 Privacy Policy

The CCI's investigation, initiated in March 2021, scrutinized WhatsApp's revised privacy policy. This policy introduced mandatory data sharing with Facebook (now Meta) and its subsidiaries, while also broadening the scope of data collection. Previously, users had the option to decide whether to share their data, a feature available since 2016.

The updated policy began rolling out in January 2021, with plans for full implementation in February 2021. It required users to accept the new terms to continue using the platform. WhatsApp, however, maintained that this update did not affect the privacy of users' personal messages but focused instead on introducing optional business tools.

Meta's Position on the Privacy Policy

Meta has reiterated that the 2021 update was designed to enhance business features and increase transparency regarding data collection and usage. A spokesperson clarified that no users were forced to accept the update, nor did anyone lose access to WhatsApp services due to non-compliance.

According to Meta, WhatsApp has been an invaluable tool for users and businesses alike.
