Biden Administration to lift Title 42 Border Policy

News Synopsis

The Biden Administration officially plans to terminate the use of Title 42, issued by the public health authority during the Trump era. 

Under Title 42 border policy, the government can immediately deny those who are trying to cross the US-Mexico border illegally or who are seeking asylum at a border crossing. The policy has prevented more than 1.7 million migrants from crossing the border since the Trump administration hinted at it in March 2020, according to official reports. These people have often been turned away and sent back to Mexico.

The Biden administration will lift the policy on May 23. At the end of title 42, the government will retain their migrants again before they blame them or release them to asylum.

However, border officials have expressed concern that withdrawing Title 42 without a strict return policy could lead to dangerous overcrowding of border facilities. They will be overwhelmed by the release of people from countries that would normally be imprisoned or deported.

The final decision of the order is pending because the White House’s Office of Information and Regulatory Affairs has yet to finalise it as soon as Wednesday. Then, the CDC will further determine the retraction of title 42.
